1. Acceptance of Terms

By accessing or using Port Buddy (the "Service"), you agree to be bound by these Terms and Conditions. If you do not agree with any part of these terms, you may not access or use the Service. If you are using the Service on behalf of an organization, you represent that you have the authority to bind that organization to these terms.

2. Description of Service

Port Buddy provides a tool that allows you to share a port opened on your local host or private network to the public network. It is a proxy and reverse-tunneling service that facilitates remote access to local development environments. The Service is provided for legitimate development, testing, and demonstration purposes only.

3. User Accounts

To use certain features of Port Buddy, you must register for an account. You are responsible for maintaining the confidentiality of your account credentials, API tokens, and for all activities that occur under your account. You must be at least 18 years of age, or the age of majority in your jurisdiction, to use the Service. You agree to provide accurate and complete information and to keep it up to date. You are responsible for all traffic, content, and activity that passes through any tunnel created under your account, whether authorized by you or not.

4. Acceptable Use & Strictly Prohibited Activities

Port Buddy is intended for lawful, legitimate purposes only. Any use of the Service for illegal, fraudulent, abusive, deceptive, or otherwise illegitimate purposes is strictly prohibited and will result in immediate suspension or termination of your account without notice and without refund.

Prohibited activities include, but are not limited to, the following. This list is illustrative and not exhaustive:

  • Any activity that violates any applicable local, national, or international law, regulation, or third-party right.
  • Hosting, distributing, transmitting, or linking to malware, ransomware, spyware, viruses, worms, trojans, or any other malicious code.
  • Phishing, spoofing, credential harvesting, impersonation, or any attempt to deceive or defraud others.
  • Launching or facilitating denial-of-service (DoS/DDoS) attacks, port scanning, intrusion attempts, botnets, command-and-control infrastructure, or any unauthorized access to systems or networks.
  • Sending spam, unsolicited bulk messages, or operating unsolicited mass-mailing or messaging systems.
  • Hosting or distributing child sexual abuse material (CSAM), non-consensual intimate imagery, or any content that exploits or endangers minors. Such activity will be reported to the appropriate authorities.
  • Distributing pirated software, copyrighted material, counterfeit goods, or content that infringes intellectual property rights.
  • Facilitating the sale or distribution of illegal goods, controlled substances, weapons, or stolen data.
  • Hosting content that is defamatory, harassing, threatening, hateful, or that incites violence.
  • Cryptocurrency mining, and any other resource-abusive activity not consistent with normal development use.
  • Concealing, obscuring, or misrepresenting the origin, nature, or destination of network traffic to evade detection, filtering, sanctions, or law enforcement.
  • Attempting to circumvent, disable, or interfere with any security, rate-limiting, abuse-prevention, or authentication feature of the Service.
  • Reselling, sublicensing, or providing the Service to third parties without our express written consent.
  • Using the Service for high-traffic production workloads beyond your subscription limits, or otherwise abusing infrastructure resources.
  • Creating multiple or automated accounts to evade limits, bans, or detection.

5. Enforcement, Suspension & Termination

We reserve the right, at our sole discretion and without prior notice, to investigate, monitor for abuse, throttle, suspend, block, or permanently terminate any account or tunnel that we reasonably believe is engaged in prohibited, abusive, threatening, fraudulent, or otherwise illegitimate activity, or that poses a risk to the Service, our infrastructure, other users, or any third party.

We may block client IP addresses, subdomains, or custom domains, and may cooperate with, and disclose relevant information to, law enforcement or affected third parties where we believe in good faith that such disclosure is necessary or appropriate. We are not obligated to provide advance warning before taking enforcement action.

6. Subscription, Billing & Refunds

Port Buddy offers both free and paid subscription plans. By subscribing to a paid plan, you authorize us (and our payment processor) to charge the specified fees on a recurring basis until you cancel. Subscriptions renew automatically unless cancelled before the end of the current billing period. You are responsible for all applicable taxes.

Except where required by applicable law, all fees are non-refundable. In particular, and without limitation:

  • If your account is suspended, blocked, or terminated due to abuse, misuse, threats, fraud, violation of these Terms, or any other illegitimate activity, you will not be entitled to any refund, credit, or compensation for any unused portion of your subscription or any fees already paid.
  • We do not provide refunds for partial billing periods, unused time, forgotten cancellations, or lack of usage.
  • Downgrading or cancelling a plan takes effect at the end of the current billing period, and no prorated refund is issued.

We reserve the right to change our pricing at any time. Any price changes will apply to your next billing cycle following notice to you.

7. Indemnification

You agree to indemnify, defend, and hold harmless Port Buddy, its operators, affiliates, and their respective officers, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or in any way connected with your use of the Service, your content or traffic, your violation of these Terms, or your violation of any law or third-party right.

8. Disclaimer of Warranties

Port Buddy is provided "as is" and "as available" without warranties of any kind, whether express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, non-infringement, availability, or uninterrupted or error-free operation. You use the Service at your own risk. We do not guarantee any particular level of uptime, performance, or data retention.

9. Limitation of Liability

To the maximum extent permitted by law, in no event shall Port Buddy or its operators be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, data, goodwill, or business, arising out of or related to your use of (or inability to use) the Service, even if advised of the possibility of such damages. Our total aggregate liability for any claim arising out of or relating to the Service shall not exceed the amount you paid us for the Service in the three (3) months preceding the event giving rise to the claim.

10. Changes to Terms

We reserve the right to modify these terms at any time. We will notify users of any significant changes by posting the new terms on our website. Your continued use of the Service after such changes constitutes your acceptance of the revised terms.

11. Governing Law & Severability

These Terms are governed by and construed in accordance with applicable law, without regard to conflict-of-law principles. If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.
